1. About these terms
By using F-Brand Score (the "Service" — fbrandscore.ai), you agree to these Terms. The Service is operated by [Operator], a self-employed individual registered in Portugal ("we", "us"). If you don't agree, don't use the Service.
2. What the Service does
F-Brand Score takes a company URL and returns a weighted brand score (0–100) aggregated across multiple large language models, plus a written summary. Optional paid features include a downloadable PDF report and a weekly auto-re-analysis subscription with email alerts.
The score is a directional signal, not a precise measurement. We do not warrant that any score is "correct" — see the limitation of liability below.
3. Accounts
- You need an account to submit URLs for analysis. Accounts are managed by Clerk.
- You must be at least 16 years old (the EU-GDPR consent threshold) and capable of entering into a binding contract.
- You're responsible for keeping your sign-in credentials safe.
- One person, one account. Don't share or resell accounts.
4. Free tier
Authenticated accounts get 3 brand-score analyses per 24-hour rolling window at no charge. Cached results (re-running the same URL within the cache TTL) don't count against the quota. We may change the free-tier limits with reasonable notice.
5. Paid services
PDF Report. US$29 per report, charged at the time of purchase via Stripe. The report renders asynchronously and is delivered to your dashboard plus your email within a few minutes.
Monitor subscription. US$19 / month. Recurring billing is not yet wired; Monitor sign-ups currently start a free trial of indefinite length while subscription billing is in development. If we begin charging, we will email each existing trial user before any charge so you can confirm or cancel without surprise.
6. Refunds
For PDF reports: if the generated report fails to render, the brand identity is wrong, or the scores look obviously broken (e.g. all zeroes), email hello@fbrandscore.ai within 24 hours of purchase and we will refund in full, no follow-up needed.
EU/EEA consumers: under the EU Consumer Rights Directive, you have a 14-day withdrawal right on digital content purchases. By initiating an analysis or requesting PDF generation, you expressly consent to immediate performance and acknowledge that this waives your withdrawal right with respect to that specific purchase. The 24-hour quality refund above is offered separately on goodwill terms.
7. Acceptable use
You agree not to:
- Use the Service to violate any law or third party's rights
- Submit URLs you don't have a legitimate interest in analysing (we're a brand-intelligence tool, not a denial-of-service amplifier)
- Attempt to scrape, reverse-engineer, or bypass the rate limits
- Resell raw access to the Service (using the scores in your own paid product / report is fine; reselling the API call itself is not)
- Use the Service to harass, defame, or build profiles intended to harm a specific individual
We may suspend or terminate accounts that breach these terms. Where reasonable, we'll warn you first.
8. Service availability
We aim for high availability but do not guarantee a specific uptime SLA at this stage. Scheduled maintenance and unexpected outages can happen. The free tier is provided as-is. Paid PDF reports are guaranteed to either render successfully or be refunded under §6.
9. Intellectual property
Our IP. The Service's code, design, copy, scoring methodology, and brand assets (including the "F-Brand Score" name and logo) belong to us. You don't get any rights to them beyond using the Service.
Your output. The brand score and PDF report we generate from a URL you submit are yours to use — internally, in client decks, in published material — with attribution appreciated but not required. We retain the right to use the same scoring outputs internally to improve the model and to keep our cache useful.
Public sources. The underlying data we analyse comes from publicly indexed web sources via search APIs. We don't claim ownership of any of that third-party content.
10. Third-party services
The Service depends on third-party providers (listed in our Privacy Policy). We don't control those providers and aren't responsible for their downtime, pricing changes, or terms changes. If a provider becomes unavailable and degrades the Service, we'll do our best to route around it but cannot guarantee a specific feature will keep working.
11. Disclaimers and limitation of liability
The Service is provided "as is" and "as available", without any warranty of accuracy, fitness for a particular purpose, or non-infringement. Brand scores are an algorithmic synthesis of public data and AI inference — they arenot a substitute for professional brand strategy, legal advice, or due diligence.
To the maximum extent permitted by Portuguese law, our total liability to you for any claim arising out of the Service is capped at the greater of (a) the total fees you paid us in the 12 months before the claim arose, or (b) US$50. We are not liable for indirect, consequential, or business-loss damages.
Nothing in these Terms limits any liability that cannot be limited under the mandatory consumer-protection law of your jurisdiction.
12. Termination
You can delete your account at any time by emailing hello@fbrandscore.ai. We can suspend or terminate your account if you breach these terms or if continuing to serve you becomes legally or commercially impossible. Outstanding refunds, if any, will be honoured. Sections 6 (refunds), 9 (IP), and 11 (liability) survive termination.
13. Changes to these terms
We may update these Terms over time. The "last updated" date at the top of the page reflects the most recent change. For any change that materially reduces your rights or increases your obligations, we'll notify you by email at least 14 days before it takes effect, and you can cancel paid subscriptions before that date without penalty.
14. Governing law and disputes
These Terms are governed by the law of Portugal, without regard to conflict-of-laws rules. Any dispute that cannot be resolved by good-faith email exchange goes to the courts of Portugal — except where you are an EU consumer, in which case you may also bring proceedings in the courts of your country of residence under the mandatory protections of EU consumer law.
EU consumers may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
